1. Acceptance of Terms
By accessing or using Avolve, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms form a binding agreement between you and Avolve, LLC, a Delaware limited liability company (“Avolve,” “we,” or “us”).
2. Description of Service
Avolve is a platform that provides personal and collective transformation tools through gamified experiences. We reserve the right to modify or discontinue any part of the service at any time.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
4. Acceptable Use
You agree not to misuse the platform, interfere with its operation, or use it for any unlawful purpose. We reserve the right to suspend or terminate accounts that violate these terms.
5. Intellectual Property
All content, trademarks, and materials on Avolve are owned by Avolve, LLC. You may not reproduce, distribute, or create derivative works without prior written consent. Content you submit remains yours; you grant us a non-exclusive license to host and display it for the purpose of operating the service.
6. Subscription Billing & Auto-Renewal
Avolve offers paid subscription tiers (Superhuman, Supersociety, Supergenius) on monthly or annual billing cycles. Pricing for each tier is shown on our pricing page at the time of purchase.
Auto-renewal: Subscriptions renew automatically at the end of each billing period until cancelled. By subscribing, you authorize us — through our payment processor, Stripe — to charge your payment method on each renewal at the then-current price for your tier. We will notify you in advance of any material price change for your subscription.
Taxes: Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any sales, use, value-added, or similar taxes that apply to your subscription.
7. Cancellation & Refunds
Cancel anytime: You can cancel your subscription at any time through the Customer Portal in your account settings, or by emailing billing@avolve.io. Cancellation stops auto-renewal at the end of the current billing period. You retain access to your tier through the end of that period.
Refunds: Subscription fees are generally non-refundable for partial billing periods. If you believe you were charged in error, contact billing@avolve.io within 30 days and we will review your request in good faith. Where required by law, we will provide refunds in accordance with applicable consumer protection rules.
8. Termination
You may close your account at any time. We may suspend or terminate your account for breach of these terms, for fraudulent or unlawful activity, or where required by law. Upon termination, the licenses granted to you end and we may delete your data subject to our data retention practices described in our Privacy Policy.
9. Disclaimers
The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Avolve, LLC and its officers, members, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising from your use of the platform. Our aggregate liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars (USD 100).
11. Governing Law & Dispute Resolution
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these terms or your use of the platform will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer rights you may have under the law of your home jurisdiction.
12. Changes to Terms
We may update these terms from time to time. For material changes, we will notify you in advance by email or through the platform. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
